It will have been nearly a year since his mistrial before Leonard Berry is back in court for a new trial.
The 62 year old Spirit River man is accused of trying to strangle a police officer and leaving him in a ditch last August.
He was previously on trial in February, but a mistrial was declared when a female witness perjured herself.
She is also now facing charges.
Berry will again be tried on January 19th to 23rd, 2015.
