Site C dam legal challenge dismissed

A lawsuit by two B.C. First Nations against the Site C dam has been dismissed by the court of appeal. The Prophet River and West Moberly First Nations had argued the hydroelectric project would have significant adverse effects on the environment and their treaty rights.

Justice Richard Boivin ruled Monday that it was within the federal cabinet’s power to approve the environmental permits that gave the dam the green light in 2014. The three-judge appeal panel also agreed that a judicial review is not the right place to decide whether or not the rights of First Nations have been violated.

The appeal was dismissed with costs.
